Terms of Service

These Terms of Service (“Terms”) govern your use of SiteForeman (“the platform”), operated by SiteForeman Pty Ltd, ACN 700 234 813 (“we”, “us”, “our”). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.

What SiteForeman is

SiteForeman is a project-management tool for Australian owner builders. It helps you read your building plans, produce cost estimates and a build timeline, generate quote requests to tradespeople, and track quotes, budgets and inspections. It is a software tool to help you organise your build — it is not a builder, a licensed building practitioner, a quantity surveyor, a lawyer, or a provider of professional building, financial or legal advice.

Estimates are guides, not quotes

Cost estimates, quantities, timelines and other figures produced by the platform are automated approximations generated from the plans you upload and general Australian construction rates. They will not match the actual cost of your build. They are provided as a planning guide only. You must obtain written quotes from licensed tradespeople and rely on those — not our estimates — before committing to any spend or entering any contract. We do not warrant the accuracy or completeness of any estimate or plan analysis.

Your responsibilities as an owner builder

You are solely responsible for your build, including obtaining the correct owner-builder permit, complying with all applicable building codes, regulations and mandatory inspection requirements in your state or territory, engaging appropriately licensed and insured tradespeople, and meeting your legal obligations. Inspection reminders and stage guidance in the platform are general information only and do not replace the requirements of your building surveyor, permit or relevant authority. You must verify all requirements independently.

Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account. You must be at least 18 years old and use the platform for a lawful purpose.

Payment

Access is provided for a one-time payment per build project, as shown at checkout. Payment is processed by Stripe. Your payment activates access to create a project as described at the time of purchase.

Refunds and your consumer rights

Your rights under the Australian Consumer Law cannot be excluded, and nothing in these Terms tries to. SiteForeman comes with guarantees that cannot be excluded under the ACL — including that the service will be provided with due care and skill and be reasonably fit for its stated purpose.

If something goes wrong, you are entitled to a remedy. Where there has been a major failure — for example the service is substantially unfit for its stated purpose, or cannot be made fit within a reasonable time — you may choose a refund. For a failure that is not major, we will fix the problem within a reasonable time, and if we cannot, you may seek a refund of the amount paid.

Beyond those rights: if you purchase and find the platform is not right for you, contact us at contact@getsiteforeman.com.au and we will consider a refund on a case-by-case basis. We would rather refund a dissatisfied owner builder than have you carry software you are not using. Tell us what went wrong either way — it is how the product improves.

We do not charge a subscription, so there is nothing to cancel. Access to a project you have paid for continues as described at the time of purchase.

Sending messages to tradespeople

The platform lets you generate and send quote-request emails and SMS messages to tradespeople you choose. You are responsible for the recipients you add, for having a proper basis to contact them, and for reviewing and editing each message before it is sent. You must not use the platform to send unlawful, misleading or unsolicited bulk messages.

Acceptable use

You agree not to:

  • use the platform for any unlawful purpose or in breach of these Terms;
  • upload content you do not have the right to upload, or that infringes anyone’s rights;
  • attempt to gain unauthorised access to the platform or interfere with its operation;
  • resell, copy or misuse the platform or its outputs.

Our intellectual property

SiteForeman — the platform, its source code, its interface and design, its written guides and articles, its cost catalogue and stage structure, and the name and logo — is our intellectual property, protected by copyright. Copyright arises automatically; no registration is required in Australia.

You may use the platform for your own building projects, and you may of course use, print and share the outputs it produces for your build — estimates, timelines, quote requests. What you may not do is:

  • copy, reproduce or republish the platform, its code, its guides or its cost data as your own, or to build a competing product;
  • scrape, bulk-extract or systematically harvest content or data from the platform;
  • reverse engineer or attempt to derive our source code, rate data or prompts, except to the extent that restriction is not permitted by law;
  • use our name, logo or branding in a way that suggests association or endorsement.

To be clear about the boundary: we make no claim over the idea of owner-builder project management software. Nobody can own that, and we would not try. What we own is our particular expression of it — this code, this writing, this brand.

Your content

You retain ownership of the plans, project data and other content you upload. You grant us the limited licence needed to process that content to provide the platform’s features (including sending it to the third-party services described in our Privacy Policy).

Availability

We aim to keep the platform available and working, but we provide it “as is” and do not guarantee it will be uninterrupted or error-free. We may update, change or discontinue features from time to time.

What we are responsible for, and what you are

We are responsible for providing the platform with due care and skill, and for it doing what we say it does on this site. If it does not, you have the remedies described above and under the Australian Consumer Law. We do not attempt to cap or exclude those rights.

What we are not responsible for is the decisions you make on your build. In particular:

  • Estimates are not quotes. Our figures are automated approximations from your plans and general published rates. They will not match your actual cost. Obtain written quotes from licensed tradespeople and rely on those.
  • Compliance information is general. Permit, inspection and licensing requirements are set by your state or territory and change. Confirm them with your regulator and your building surveyor — not with this platform.
  • You choose and manage your trades. We do not vet, recommend, employ or supervise any tradesperson, and we are not a party to any arrangement between you and them.
  • You remain the owner builder. The legal responsibilities of that role — permits, safety, compliance, engaging licensed trades — are yours and cannot be delegated to a software tool.

Put plainly: this is a tool for organising a build, and it is only as good as the plans you give it and the judgement you apply to what it produces. We have built it carefully and we stand behind it doing its job — but we cannot stand behind construction decisions we are not party to.

Changes to these Terms

We may update these Terms from time to time. The “last updated” date above shows when they last changed. Continued use of the platform after a change means you accept the updated Terms.
